The former manager, who had “exceeded expectations” in her annual performance reviews for seven consecutive years, alleges that Republic Services promised her a promotion for almost two years, only to use her as a symbol of diversity. For example, Republic asked him to help its attorneys in negotiations with the Teamsters, who were calling for an end to “Republic’s plantation mentality.” But once the negotiations were over, rather than fulfilling their promise, Republic promoted a less experienced and younger white man.

She further alleges that the Republic decorated her with recognition as a tactic to assuage her complaints. For example, Republic invited her to join the exclusive McKinsey Black Leadership program, as just 1 of 6 black employees across the entire company, while ignoring her complaints, including:

  • His supervisor, a white man, repeatedly called black frontline workers “dem boys.”
  • During a meeting, her supervisor, a white male, told black supervisors to “fight back” the police when a driver was given a ticket. When a black employee objected to this order, the white supervisor laughed and said, “We wouldn’t want you dragged.”
  • When she told her supervisor, a white man, that a truck was too dangerous to drive, he told her, “The boys are going to do what I tell them to do. A few weeks later, the truck overturned in the dump, injuring a black employee.
  • Her supervisors manipulated employee surveys documenting employee feelings about diversity and inclusion in the workplace.

Republic fired her for “irreconcilable differences” when it had just deemed her, through a highly acclaimed corporate review program, as “the top talent, ready now for the next role.”
